The EU cybersecurity legislation introduced in 2016 was updated by the NIS2 Directive, which came into force in 2023. It modernized the existing legal framework to keep pace with increasing digitalization and an evolving cybersecurity threat landscape. By extending the scope of cybersecurity legislation to new sectors and entities, it further improves the resilience and response capacities of public and private entities, competent authorities and the EU as a whole.

Fines and consequences:

Fines of up to 10 million euros or up to 2% of the global annual turnover of the previous financial year, whichever is higher, can be imposed for breaches.

Why does the NIS2 directive need to be implemented?

Increased cyber security: protection of critical infrastructures and services is strengthened.

Better protection for citizens: EU citizens’ personal data and digital services are better protected.

Crisis resilience: Companies and organizations become more resistant to cyber attacks.

Uniform standards: Creation of a harmonized level of security within the EU.

Increased transparency: Improved reporting and communication of security incidents.

Challenges

Implementation costs: Companies have to invest in new security measures and technologies.

Complexity of compliance: Compliance with the directive requires extensive adjustments and regular reviews.

Resource requirements: Smaller and medium-sized companies may find it difficult to meet the requirements.

Coordination and cooperation: Effective cooperation between different national authorities and companies is necessary.
